Terms and Conditions
These Terms and Conditions govern your use of the EvenShare mobile application and related services operated by EvenShare. By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.
1. Eligibility
- You must be at least 13 years old to use EvenShare.
- If you are between 13 and 18 years old, your parent or guardian must review and agree to these terms on your behalf.
- You must provide accurate account information and keep your login credentials secure.
- You are responsible for all activity that occurs under your account.
2. Service Description
- EvenShare helps users record shared expenses, track balances, manage groups, and store payment method preferences.
- EvenShare does not move money, process payments, hold funds, act as a bank, or function as a money services business.
- All real payment settlement between users happens outside the app through third-party platforms such as Venmo, Cash App, Zelle, and PayPal.
3. Account Responsibilities
- You must keep your account credentials confidential.
- Notify us immediately at info@namastack.com if you suspect unauthorized access.
- You may not share your account or create accounts for others without their consent.
4. Acceptable Use
You agree not to use EvenShare to:
- Harass, threaten, impersonate, or defraud any person.
- Upload content or payment details you do not have permission to use.
- Record false or fabricated expenses to deceive other users.
- Attempt to access, disrupt, or interfere with the service or any other user's account or data.
- Violate any applicable law or regulation.
- Use the service for any commercial purpose not expressly authorized by EvenShare.
5. User Content
- You retain rights to the information and content you submit.
- By submitting content, you grant EvenShare a non-exclusive license to store, process, and display it only as needed to operate the service.
- You represent that you have the right to submit any content you provide.
6. Payments and Disputes
- Users are responsible for confirming amounts, recipients, and settlement arrangements before recording transactions.
- EvenShare does not guarantee that balances recorded in the app will be settled by any user.
- EvenShare is not responsible for disputes between users, payment failures, chargebacks, collections, or losses arising from off-platform payment activity.
7. Intellectual Property
- The EvenShare name, design, and software are protected by applicable intellectual property laws.
- You may not copy, modify, distribute, or create derivative works from the service without written permission.
8. Termination
- We may suspend or terminate accounts that violate these terms or create legal or security risk.
- You may stop using the service at any time and may delete your account from inside the app.
9. Disclaimers
- The service is provided on an as-is and as-available basis without warranties of any kind.
- We do not guarantee that the service will be uninterrupted or error-free.
- We are not responsible for inaccurate expense data entered by users.
10. Limitation of Liability
- To the fullest extent permitted by law, EvenShare is not liable for indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim relating to the service will not exceed the greater of the amount you paid in the prior twelve months or $100 USD.
11. Indemnification
You agree to indemnify, defend, and hold harmless EvenShare and its officers, directors, employees, and agents from claims, damages, losses, liabilities, and expenses arising out of your use of the service, your violation of these terms, your violation of third-party rights, or any content you submit.
12. Governing Law and Dispute Resolution
- These terms are governed by the laws of the State of Texas, United States.
- Disputes should first be attempted to be resolved through good-faith negotiation.
- If unresolved, disputes may be submitted to binding arbitration, except where a court may grant injunctive relief for intellectual property claims.
- You agree to resolve disputes individually and waive participation in class action proceedings.
13. Changes to These Terms
We may update these terms from time to time. Continued use of EvenShare after an update constitutes acceptance of the revised terms.
14. Severability
If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
15. Entire Agreement
These terms, together with the Privacy Policy, constitute the entire agreement between you and EvenShare regarding the service.
